Sofern noch keine Dienstleistungen erbracht wurden, kann diese Einwilligung jederzeit widerrufen werden. Wenn bereits Dienstleistungen erbracht wurden werden die Daten lediglich zum Nachweis der korrekten Abwicklung der bisherigen Tätigkeit (z.B.: Dokumentation der Hebammenleistung, Abrechnung der Hebammenleistung) verwendet. Durch den Widerruf der Einwilligung wird die Rechtmäßigkeit der aufgrund der Einwilligung bis zum Widerruf verarbeiteten Daten nicht berührt.
Ihre Daten werden nach Ablauf der gesetzlichen Aufbewahrungspflichten für Dokumentation und Abrechnung (30 Jahre bei Hausgeburten, in allen anderen Fällen 10 Jahren) unwiderruflich gelöscht. Ihre Daten geben wir nicht ohne Ihre Einwilligung weiter - mit Ausnahme gesetzlicher Verpflichtungen wie der Abrechnung.
Ich verarbeite die Daten in Übereinstimmung mit den datenschutzrechtlichen Bestimmungen.
Ihnen stehen grundsätzlich die Rechte auf Auskunft, Berichtigung, Löschung, Einschränkung, Datenübertragbarkeit, Widerruf und Widerspruch zu. Wenn Sie glauben, dass die Verarbeitung Ihrer Daten gegen das Datenschutzrecht verstößt oder Ihre datenschutzrechtlichen Ansprüche sonst in einer Weise verletzt worden sind, können Sie sich bei der Aufsichtsbehörde beschweren.
General Terms and Conditions (GTC)
1 Scope of application
The following general terms and conditions apply to the contract between the midwife Susanne Fahey and the person being cared for, unless otherwise specified.
2 Conclusion of contract
Yes, I wish to use the services of the freelance midwife and receive the necessary midwifery services from her. These consist in particular of counselling, prenatal care, assistance with pregnancy complaints, CTG monitoring, postnatal care and advice during breastfeeding.
The following services are not included in this agreement and require a separate agreement: optional services, participation in courses and care during labour. Also not covered are patient transport, medical services and the services of other professional groups.
In the following cases, the costs are not covered by statutory health insurance and will therefore be invoiced to me privately as a self-payer:
- If no valid membership of the health insurance company mentioned below can be established.
- Agreed appointments that were not kept by me and were not cancelled at least 24 hours before the appointment.
- If services are utilised by several midwives and the reimbursable quotas are exceeded as a result. In order to avoid this, I will inform the midwife of all services that I am using or have used with a colleague at the expense of my health insurance.
- If my health insurance company refuses to pay the extensive travelling expenses in my case.
Further optional services (e.g. on-call service, acupuncture, etc.) will be agreed separately.
3 Collection, use and processing of personal data
The midwife Susanne Fahey is hereby informed that personal data relating to those receiving care is stored and processed electronically. In the case of services that are billed via the Midwifery Fees Ordinance, the midwife stores personal data in automated files and forwards these electronically to the central billing centre. The registration signed by the person being cared for includes his/her express consent to this.
4 Liability
Participation in all courses offered by Susanne Faehy is at the participant's own risk. No liability whatsoever is assumed for wardrobe and other property of the contractual partner. Any liability for damages - with the exception of liability for intent and gross negligence - is excluded.
5 Written form/miscellaneous
Verbal collateral agreements do not exist and must be made in writing to be valid. Additions, amendments or collateral agreements to these terms and conditions as well as unilateral declarations of intent require the written confirmation of the midwife Susanne Fahey to be effective. This also applies to the cancellation of the written form requirement.
6 Place of jurisdiction
The place of jurisdiction is Munich.
Consumers are entitled to a right of withdrawal under the following conditions: A consumer is any natural person who concludes a legal transaction for purposes that cannot be predominantly attributed to either their commercial or independent professional activity. The midwife/midwifery practice points out the following to the participant: You have the right to cancel this contract within 14 days without giving reasons. The cancellation period is 14 days from the day the contract is concluded. In order to exercise your right of withdrawal, you must inform the midwife of your decision to withdraw from this contract by means of a clear statement (e.g. a letter sent by post or by email). In order to meet the cancellation period, it is sufficient that you send the notification of your exercise of the right of cancellation before the cancellation period expires.
Consequences of revocation
The midwife/midwifery practice must repay all payments received from the participant immediately, but at the latest within 14 days from the day on which notification of the revocation was received. If the participant has requested that the service begin during the cancellation period, she must pay the midwifery practice an appropriate amount that corresponds to the proportion of the service used up to that point.
